Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Fetra AI ("Fetra", "we", "us", or "our"). They govern your access to and use of Fetra websites, applications, onboarding flows, workspaces, AI social media manager, publishing tools, content library, analytics, support, and related services (collectively, the "Service").

By creating an account, connecting a social account, clicking an acceptance button, or using the Service, you agree to these Terms. If you use Fetra on behalf of a company, organization, or client, you represent that you have authority to bind that entity, and "you" includes that entity.

If you have a separate signed agreement, order form, data processing agreement, or platform-specific addendum with Fetra, that document controls where it conflicts with these Terms.

Fetra may allow you to connect Instagram, Facebook, LinkedIn, X, TikTok, YouTube, Google Business Profile, or other third-party services. These integrations are provided by third parties and may require OAuth authorization, access tokens, page permissions, profile data, publishing scopes, or other credentials.

When you connect a third-party account, you authorize Fetra and its service providers to access, store, use, and transmit information from that account as needed to provide the Service, including drafting, scheduling, publishing, retrieving post status, and displaying account information.

You must comply with all third-party platform terms, developer policies, community guidelines, advertising rules, and applicable laws. Fetra is not responsible for platform outages, API limits, permission changes, content takedowns, account restrictions, or decisions made by third-party platforms.

Fetra uses artificial intelligence to help generate content ideas, captions, scripts, replies, plans, summaries, and recommendations. AI output is generated from patterns in data and the context you provide. It may be incomplete, inaccurate, offensive, repetitive, outdated, or unsuitable for your audience or legal obligations.

You are responsible for reviewing, approving, editing, and deciding whether to publish AI-generated content. Do not rely on Fetra as a substitute for professional legal, tax, medical, financial, compliance, or public relations advice.

If you publish or send content through Fetra, you are responsible for ensuring that it is truthful, substantiated, properly disclosed, authorized, and compliant with applicable laws, platform rules, advertising standards, intellectual property rights, and industry-specific requirements.

You retain ownership of content, files, prompts, brand materials, social account data, images, videos, copy, logos, comments, and other materials you submit to or create with Fetra ("User Content").

You grant Fetra a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, display, transmit, and create derivative works from User Content solely as needed to provide, secure, support, improve, and operate the Service and as otherwise allowed by our Privacy Policy or your settings.

You represent that you have all rights and permissions needed to upload, use, process, publish, and authorize Fetra to work with your User Content, including rights in logos, images, videos, music, likenesses, testimonials, customer data, and third-party materials.

You may not use Fetra, or help anyone else use Fetra, to:

Fetra may offer free, trial, beta, paid, usage-based, or enterprise plans. Plan limits, included features, AI usage, connected accounts, storage, seats, scheduling capacity, and prices may be described at checkout, in-product, or in an order form.

Paid subscriptions renew automatically unless canceled before the renewal date. You authorize Fetra and its payment processors to charge applicable fees, taxes, and renewal amounts using your selected payment method.

If payment fails or your account exceeds plan limits, we may downgrade, suspend, limit, or terminate access to paid features after reasonable notice where practical. You are responsible for taxes, duties, and similar government charges that apply to your purchase.

Fetra and its licensors own the Service, software, models, workflows, templates, designs, interfaces, documentation, branding, logos, and other materials we provide, excluding your User Content and third-party materials. These Terms do not transfer ownership of Fetra intellectual property to you.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business, creator, or client work. You may not remove proprietary notices or use Fetra marks without written permission.

If either party receives non-public information that a reasonable person would understand to be confidential, the receiving party will use reasonable care to protect it and will use it only to perform under these Terms. Confidentiality obligations do not apply to information that is public, independently developed, rightfully received from another source, or required to be disclosed by law.

If you send ideas, suggestions, or feedback, you allow Fetra to use them to improve, develop, and operate the Service.

Our Privacy Policy explains how we collect, use, share, retain, and protect personal information. By using the Service, you acknowledge that Fetra will process personal information as described in the Privacy Policy.

If you use Fetra for a business, client, employee, or customer, you are responsible for providing required notices, obtaining required consents, and ensuring you have a lawful basis to upload and process personal information through the Service. If required, a separate data processing agreement may apply.

You may stop using Fetra at any time. You may cancel paid plans through the account settings or by contacting support where self-service cancellation is unavailable.

We may suspend or terminate access to the Service, remove content, or limit features if we reasonably believe that you violated these Terms, created risk for Fetra or others, failed to pay fees, used the Service unlawfully, or if continued access may harm security, availability, third-party platforms, or other users.

Upon termination, your right to access the Service ends. We may retain or delete data according to our Privacy Policy, legal obligations, backup practices, and legitimate business needs.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Fetra disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.

We do not guarantee that AI output will be accurate, unique, non-infringing, compliant, or appropriate for your use case. We do not guarantee social platform availability, account growth, reach, engagement, revenue, ranking, publishing success, or business outcomes.

Fetra is designed to support planning, drafting, scheduling, and workflow decisions. You remain responsible for reviewing content, approving publication, complying with platform rules, and making business decisions based on your own judgment.

Service availability, platform integrations, AI output, account growth, reach, engagement, and business outcomes may vary. We may change, pause, or discontinue features when needed to protect the Service, comply with law, or adapt to third-party platform requirements.

Unless a separate written agreement says otherwise, these Terms are governed by the laws of the State of California, United States, excluding conflict-of-law rules. Courts located in San Francisco County, California, and the federal courts for the Northern District of California will have exclusive jurisdiction, except where applicable consumer or data protection law gives you rights that cannot be waived.

Before filing a claim, each party will try to resolve the dispute informally by contacting the other party and giving at least 30 days to respond, unless urgent injunctive relief is needed.

We may update these Terms from time to time. If changes are material, we will provide reasonable notice, such as through the Service, by email, or by posting an updated effective date. Your continued use of the Service after changes take effect means you accept the updated Terms.
